Purchase Terms of Agreement

The purchase of digital products, including PDF downloads and online material is subject to the following terms and conditions. Consumers are advised to review carefully before making any purchase.

Services

I reserve the right but am not obligated, to limit the sales of my products or Services to any person, geographic region, or jurisdiction. I may exercise this right on a case-by-case basis. I reserve the right to limit the quantities of any products or services that I offer. All descriptions of products or product pricing are subject to change at any time without notice, at my sole discretion. I reserve the right to discontinue any product at any time.

I do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Refund, Return & Exchange Policy

All transactions for the purchase of services, intangible products, PDF downloads, resource material, and online content are made through payment gateways such as PayPal or Stripe that use SSL encryption. These payment gateways are safe and secure for using all types of credit cards and debit cards in different countries and your details are not stored during this process.

If your purchase is a digital product, it is deemed “used” after download or opening, and all purchases made on nadinekenneyjohnstone.com are non-refundable or exchangeable.

Workshops, classes, and services: No refunds or exchanges, unless otherwise noted.

One-on-one coaching programs: No refunds or exchanges.

Manuscript intensive: No rescheduling is permitted. If the writer fails to turn in their pages, Nadine will not read the work or give written feedback. The writer will still have a coaching session to discuss general writing concerns. No refunds or exchanges.

Retreat Refund & Cancellation Policy:

If you need to cancel your trip 60 days or more prior the retreat, you will receive full credit of what you paid applied towards a future retreat, to be used within 1.5 years of cancelation. You will not be refunded/credited if you cancel within the 60-day window. However, you can always sell or give your spot to someone else.

Please do not attend the retreat if you are actively shielding against the COVID-19. If you or someone you’ve been in close contact with has tested positive for COVID 19 within 14 days of the retreat, please withdraw your registration.

In the event of unexpected events such as natural disasters, pandemic surges and closures, etc., we will reschedule the retreat, and apply your funds to the rescheduled event. Rescheduling is the best option because of the time, care, and preparation that goes into each retreat. If we cannot reschedule, we will offer you a full refund and/or credit towards a future retreat. Please note that changes made to transportation and airfare are your responsibility. *For all of these reasons, purchasing travel insurance is highly recommended.

Your Account

I may require that you create an account to access the Nadine Kenney Johnstone Shop, including to make purchases. If I do so, you must provide accurate information about yourself when you create an account and ensure that you update us if that information changes. You must ensure that your login details remain confidential. You are responsible for any activity, including any purchases made, under your account. I reserve the right to terminate your account at any time and for any reason.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, and expiration dates so that I can complete your transactions and contact you as needed.

Subscription & Cancellation Policy

a. Subscription terms. I may offer you the ability to purchase subscriptions via my shop. Terms specific to a subscription will be disclosed to you at or prior to the time at which you purchase the subscription, and by purchasing the subscription you are agreeing to those terms.

b. Cancellation. Your cancellation rights, and the mechanism via which you may notify us of your decision to cancel, will be disclosed to you at or prior to the time at which you purchase a subscription.

No Warranties

I provide the Nadine Kenney Johnstone Shop, Nadine Kenney Johnstone Shop IP and Nadine Kenney Johnstone Shop Products “as is” and “as available”, without any express, implied, or statutory warranties of title, merchantability, fitness for a particular purpose, non-infringement, or any other type of condition, warranty or guarantee. No data, documentation or any other information provided by Nadine Kenney Johnstone or obtained by you from or through the Nadine Kenney Johnstone Shop – whether from Nadine Kenney Johnstone or another entity, and whether oral or written – creates or implies any warranty from Nadine Kenney Johnstone to you.

Nadine Kenney Johnstone disclaims any knowledge of and does not guarantee: (a) the accuracy, reliability, or correctness of any data provided through the Nadine Kenney Johnstone Shop; (b) that the Nadine Kenney Johnstone Shop products will meet your specific needs or requirements; (c) that the Nadine Kenney Johnstone Shop will be available at any particular time or location, or will function in an uninterrupted manner or be secure; (d) that Nadine Kenney Johnstone will correct any defects or errors in the Nadine Kenney Johnstone Shop; or (e) that the Nadine Kenney Johnstone Shop is free of viruses or other harmful code. Limitation of Liability

Under no circumstances will Nadine Kenney Johnstone be responsible or liable to you for any indirect, punitive, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the Nadine Kenney Johnstone Shop or for the unavailability of the Nadine Kenney Johnstone Shop, or for lost profits, personal injury, or property damage, or for any other damages arising out of, in connection with, or relating to these Terms of Use or your use of the Nadine Kenney Johnstone Shop, even if such damages are foreseeable, and whether or not you or the Nadine Kenney Johnstone has been advised of the possibility of such damages. Nadine Kenney Johnstone is not liable, and denies responsibility for, any damages, harm, or losses to you arising from or relating to hacking, tampering, or other unauthorized access or use of the Nadine Kenney Johnstone Shop or your failure to use or implement anti-fraud measures, security controls, or any other data security measure. Nadine Kenney Johnstone further denies responsibility for all liability and damages to you or others caused by (a) your access or use of the Nadine Kenney Johnstone Shop inconsistent with our instructions; (b) any unauthorized access of servers, infrastructure, or data used in connection with the Nadine Kenney Johnstone Shop; (c) any bugs, viruses, or other harmful code that may be transmitted to or through the Nadine Kenney Johnstone Shop; (d) any errors, inaccuracies, omissions, or losses in or to any data provided to us; (e) third-party content provided by you; or (f) the defamatory, offensive, or illegal conduct of others.

You agree to limit any additional liability not disclaimed or denied by Nadine Kenney Johnstone in relation to the Nadine Kenney Johnstone Shop, Nadine Kenney Johnstone Shop IP, and Nadine Kenney Johnstone Shop Products, to your direct and documented damages; and you further agree that under no circumstances will any such liability exceed in the aggregate the greater of the amounts paid by you to Nadine Kenney Johnstone during the three-month period immediately preceding the event that gave rise to your claim for damages, and USD $20.

These limitations on our liability to you will apply regardless of the legal theory on which your claim is based, including contract, tort (including negligence), strict liability, or any other theory or basis.
